These Terms of Service ("Terms") govern your use of Keto Cal AI ("the App"), operated by Joseph Bornstein ("we," "us," or "our"). By using the App, you agree to these Terms.
Keto Cal AI is a keto diet tracking tool that uses AI-powered photo analysis to estimate net carbohydrate content of food. The App provides estimates, not exact measurements. You should not rely on the App as your sole source of nutritional information.
The App is not a medical device and does not provide medical advice. The App is a lifestyle and diet tracking tool. It does not diagnose, treat, cure, or prevent any disease or medical condition. Always consult a qualified healthcare professional before making dietary changes, especially if you have diabetes or other metabolic conditions.
Food photo analysis is performed by AI (Google Gemini) and is inherently imprecise. Net carb estimates are displayed as ranges (e.g., "8-12g") to reflect this uncertainty. Actual nutritional values may differ. The App flags low-confidence results and provides tools to correct estimates, but accuracy is not guaranteed.
Sugar alcohol warnings (maltitol, IMO) are based on a curated database of known products. Not all products containing sugar alcohols may be flagged.
You may use the App anonymously during onboarding. A subscription requires Sign in with Apple. You are responsible for maintaining access to your Apple ID. We cannot recover accounts that are not linked to an Apple ID.
Free trial. New subscribers receive a 7-day free trial. You will not be charged during the trial period. If you cancel before the trial ends, you will not be charged.
Subscription plans:
Billing. Payment is charged to your Apple ID account at confirmation of purchase (or at the end of the free trial). Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period at the same price.
Cancellation. You can cancel your subscription at any time in iPhone Settings > [Your Name] > Subscriptions > Keto Cal AI > Cancel Subscription. Cancellation takes effect at the end of the current billing period — you retain access until then.
Refunds. Refund requests are handled by Apple per their refund policy. We do not process refunds directly.

The App, its design, code, and content are owned by Joseph Bornstein. Your food photos and log data remain yours — we claim no ownership of your content. You grant us a limited license to process your photos for the purpose of providing the food analysis service.
Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your data.
To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, or consequential damages arising from your use of the App. Our total liability is limited to the amount you paid for the App in the 12 months preceding the claim.
We are not responsible for dietary decisions made based on the App's estimates. The App provides informational estimates only — not nutritional guarantees.
We strive to keep the App available but do not guarantee uninterrupted service. The App depends on third-party services (Google Gemini, Supabase, Apple) that may experience downtime. We are not liable for service interruptions caused by third parties.
We may update these Terms from time to time. We will notify you of material changes via the App. Continued use of the App after changes constitutes acceptance of the updated Terms.
We may terminate or suspend your access to the App if you violate these Terms. You may stop using the App at any time by cancelling your subscription and deleting the App.
These Terms are governed by the laws of the State of New York, United States, without regard to conflict of law principles.
